Definitions
“Awaken Organics” means Awaken Organics Pty Ltd.
“Customer” or “you” means the person(s) or entity(ies) purchasing Products from Awaken Organics.
“Products” means the Awaken Organics skincare line and other products, including cleansing, toning, moisturising products.
“Terms” means these terms and conditions as amended from time to time.
- Terms of use
You agree and acknowledge that these Terms, which include our Delivery and Returns Policy [#link to page] and Privacy Policy [#link to page], comprise the entire and complete agreement between you and Awaken Organics. Your use of this website constitutes your acceptance of these Terms. If you do not agree to or cannot comply with these terms, do not use our website. In its sole discretion, Awaken Organics may change these Terms at any time without notice, by updating this website. Subject to clause 5, use of this website and purchases of Awaken Organics Products are for personal use only.
This website is intended for use by adults. By using this website, you represent that you are at least 18 years of age and you agree to provide accurate and complete personal information as requested on any Product order or account registration. If you are under 18 years of age, do not use this website or provide personal information to us. Any information provided by you or collected by Awaken Organics is subject to our Privacy Policy, which forms part of these Terms. If Awaken Organics suspect any information you have provided is incorrect, it may suspend or remove your account and amend or cancel Product orders without notice.
You may not use this website for any unauthorised or illegal purpose, including to extract, copy, store or reproduce material on the website in any manner, to reverse engineer any material on the website, or to do anything that would adversely affect the operation of the website or cause damage to Awaken Organics.
- Prices and payment
Prices for our Products may change without notice. While shopping on our website, prices that are listed for Products on their web pages or in your cart may change after Product pricing updates – please note that placing Products in your shopping cart does not reserve that Product price. Product prices will only be reserved once an order is placed. Product prices are inclusive of GST and exclusive of any shipping and handling costs.
Payment may be made by Visa, MasterCard, PayPal, Afterpay (Australia and New Zealand residents only), or by any other method as agreed to between Awaken Organics and the Customer. If you have any issues with payment, please contact us.
- Exchanges and refunds
If you change your mind on a purchase we will offer you a refund or exchange, on the following conditions:
- the Product(s) were purchased from the Awaken Organics website;
- the Product(s) must be unopened, unused and in a saleable condition;
- the Product(s) must be returned to Awaken Organics within fourteen (14) days of you receiving the Product(s);
- you are responsible for the cost of postage to return the Product(s) to Awaken Organics.
We reserve the right to refuse a refund or exchange should we deem the above conditions are not satisfied.
This exchange and refund policy is in addition to – and does not exclude, replace or diminish – your rights under Consumer Guarantees and the Australian Consumer Law.
Please note that change-of-mind refunds and exchanges are not available for end of line and individually discounted items. Please contact us at joanne@awakenorganics if you have any queries relating to refunds or exchanges.
- Products
Awaken Organics has sought to use images and descriptions that represent the Products as closely as possible, however factors including the Customer’s monitor settings may affect the way a Product looks on the website. Whilst we seek to keep the website up to date, the website’s conditions may not always reflect present information (including prices and packaging designs) of the Products.
- Wholesale
If you are interested in wholesaling the Awaken Organics range, please contact us at joanne@awakenorganics to express your interest. Unless Awaken Organics have established a wholesale relationship with a Customer, any purchases of Products are for personal use only and not for redistribution or reselling. Should a Customer violate this policy Awaken Organics will, at their discretion, reduce an order quantity or cancel an order.
- Products and medical treatment
Awaken Organics has formulated the Products as a skincare line that is designed to provide topical cleaning, toning, moisturising and similar effects to the skin. The Products are not medicinal or intended to replace or substitute medical treatment, nor diagnose, treat, prevent or cure any disease or condition. Customers with health issues, including skin conditions, who wish to use the Products should first seek professional medical advice regarding the suitability of the Products.
- Risk, liability, representations and warranties
Awaken Organics will pack your Products appropriately to seek to ensure a safe delivery. Once your order is delivered to you, risk of loss and damage to the Products passes to you.
Whilst Awaken Organics practises the utmost care in formulating its Products, we will not be held liable for any adverse reaction experienced by the Customer.
With the exception of representations and warranties that cannot be excluded by law, Awaken Organics make no representations or warranties in respect of this website and its contents, nor the merchantability or fitness for purpose of its Products.
Awaken Organics does not warrant that our website or website server are free from viruses or any other damaging components. Your use of this website is entirely at your own risk. To the fullest extent permitted by law, Awaken Organics will not be liable for any loss that arises from any use of this website, or reliance on information on this website.
- Indemnity
You agree to indemnify Awaken Organics and keep Awaken Organics indemnified from any loss, damages and costs arising from any third party claim, demand or action, arising directly or indirectly from your or your representatives’ use of this website or breach of these Terms. You agree to indemnify Awaken Organics for any loss, damages and costs arising from your or your representatives’ use of our website, and for any actions taken by you that causes damage or unreasonable load on Awaken Organics’ infrastructure, including use of data gathering and data extracting tools.
- General
You agree and acknowledge that your use of this website and any Products or services provided will be governed by the laws of Victoria, Australia and the Melbourne Registry of the appropriate Court or Tribunal in the event of any dispute. Awaken Organics assumes no responsibility for changes in the laws of Victoria or the Commonwealth of Australia that may affect the supply of Products. Any terms or conditions found to be void, unenforceable or illegal may, to the extent permitted by law, be severed from these Terms, and the remaining terms and conditions under these Terms shall continue to operate with full effect. No waiver of any of these Terms or failure to exercise a right or remedy by Awaken Organics will constitute a further waiver by Awaken Organics of the same or any other term, condition, right or remedy.

The contents of this website, including its design, text and images, are all subject to copyright owned by Awaken Organics or licensed to be used by Awaken Organics. Your use of this website may cause your browser to create a temporary copy of our website or store other information temporarily (like cookies) – Awaken Organics permits same. Unless otherwise expressly permitted by us you must not copy, reproduce, extract, share, store, transmit, publish, adapt, display, perform or create any derivative work from any part of our website for any purpose, including to commercialise any Product, information or design found on our website.
